Doctor Sentenced for Kickback Scheme

West Orange physician Dov Rand of Franklin Lakes was sentenced to five months in prison, five months of home detention and fined $30,000 on Wednesday.

A West Orange doctor who took cash payments in exchange for patient referrals was sentenced Wednesday to five months in prison and five months of home detention, the U.S. Attorney’s Office announced.

Dov Rand, 48, of Franklin Lakes, received the sentence before U.S. District Judge Claire C. Cecchi in federal court in Newark.

In addition to his prison term, Rand was sentenced to two years of supervised release and fined $30,000, the U.S. Attorney's office announced in a release.

According to court testimony, Orange Community MRI paid Rand kickbacks for each Medicare or Medicaid beneficiary MRI or CAT Scan referred since at least 2010, officials said. 

Rand and 12 other New Jersey doctors were arrested in December and charged with accepting envelopes of cash from Orange Community MRI, a diagnostic facility in Orange, according to the release.

Rand pled guilty on May 18, 2012.

This is entrapment at its worst. They came to him and solicited him. He referred less than 1% of his patients to this facility and received 5k in cash from the referrals. How can he get this type of sentencing? As well as lose his license for life. This is absolutely ridiculous. They make is seem like Dr Rand is a horrible person and solicited every one of his patients for an MRI which he did not. So the guy who received over 100k in cash from the referrals better be serving 15 yrs to make this kind of sentencing fair. I'm so disgusted by this injustice.

Five months in prison and five months home detention is equal to 15 years? Are we forgetting that he plead GUILTY? Are we so caught up in the notion that only certain people can be deemed criminals that Dr's such as these can never be held to account for their crimes? This guy was stealing from the taxpayers and using the poor to fleece us. Does that sound like a nice guy?

Sorry David that you feel this way, but, Dr. Rand, is a pain management doctor who helps people try to live a normal life with the help of med's, he had to send these people for MRI's in order to help them and make sure they are not just trying to get medication for no reason. I understand that the money taking was wrong, but the MRI's were necessary, Dr. Rand is an amazing doctor and if it wasnt for him helping me, i wouldnt be able to try and have a normal life. He got the book thrown at him for accepting $5,000,,,,,,,,, meanwhile the others took way more then that!!!!!! He did not commit fraud on Medicaid, the MRI's were NECESSARY!!!!!!

How does the Justice System, JUSTIFY this, when a Former Teacher Of The Year Accepts Plea In Teen Sex Case gets PROBATION!!!!!!!!!!! WOW our children cant be safe but this Dr. who only helps people gets prison, something wrong here!
